Late 1990s
In December of 1998, the Pennsylvania Clean Air Vehicle Program was enacted. Specific reference provisions adopted from the California Low Emission Vehicle Program to address emissions from mobile sources In Pennsylvania. The PA Clean Vehicle Emission Program does not incorporate California fuel requirements or Zero Emissions vehicles. Certain states have certain authorities under section 177 of the Federal Clean Air Act so that they can adopt emission control standards for certain motor vehicles as long as the measures have been adopted by California and have been granted a waiver of federal preemption, and are adopted at least two years in advance of the commencement of the model year. When the PA Clean Vehicles Program was adopted, certain manufacturers were allowed to opt into another federal program called the National Low Emissions Vehicle Program. The NLEV program expired in 2006 and was later replaced.
Mid-2000s
In 2006, a final-form rulemaking was approved by the Environmental Quality Board to clarify the PA Clean Vehicles Program and postpone the compliance date from the model year 2006 to the model year 2008. As a result, between 2006 and 2008, the new vehicles sold in Pennsylvania were required, at minimum, to meet the Federal Tier II emission standards.
Late 2000s
Fast forward to 2008, and the Pennsylvania Clean Vehicles Program came into effect for 2008, including several newer passenger cars and light-duty trucks. These vehicles would be eligible for the program if they were from the model year 2008 or more recent, were under 8,500 pounds gross weight, and had less than 7,500 miles driven. In addition, the PA Clean Vehicles Program adopts by reference specific provisions of the California Low Emission Vehicle Program. If you look at the studies performed in 2005 and 2006, there were significantly higher levels of pollution reduction than the existing federal mobile source emission control program. Vehicles must be certified by the California Air Resource Board so they can be e sold, leased, offered for sale or lease, imported, rented, acquired, received, titled, or registered in Pennsylvania.
